Machine Gun Ban Challenged

This is interesting. I was waiting for something like to come up since 1) The Bruen Decision and 2) The Chevron Decision. Win, lose or draw, I'm glad to see this one come up.

yeah. The judgment is good and bad. I skimmed it (12 pgs) and there are some problems. The judge's logic applying the Bruen standard is correct, but you can tell he disagrees in a few ways with the overall decision.
It probably won't go anywhere anyway.

I'm an eternal pessimist but I'm holding out hope that it will make it to SCOTUS. I expect the next court to overturn it but the gun groups should take it all the way to the top.

The current make-up of SCOTUS would not throw out '86 or GCA. They've had a couple of chances on the '86 ban and a whole bunch of 'em on GCA '68 over the years. Besides, 1 little case in 1 circuit isn't gonna make it to consideration by them.

I think the best case scenario is rolling back '86 and a few other things through congress and redefining the scope of ATF.
