2A Win in PA

In spite of all the doom and gloom we've had coming our way lately, we have scored some good wins regarding our rights to own and bear arms. Here is one we just scored in PA

He also ruled that a ban on firearms possession without a license during a state of emergency is facially unconstitutional and has enjoined Pennsylvania State Police Commissioner Col. Christopher Paris from enforcing these provisions.

Here's an analysis as provided by the lawyer who argued the case. Josh Prince is one of PA's most prominent and successful gun rights advocates in PA and most of our wins have his name on them, along with two or three organizations, none of which is the NRA, BTW.

I am pretty familiar with these laws and the changes if anyone needs help ciphering it out.

Will the state challenge that ruling?

Most likely. Since it's not their money that they're spending, they always do. The lack of accountability on their part is one of my pet peeves.

In MS, your car is considered an extension of your home. If that's the case in PA, this case ought to be a big win .. when it eventually plays out.

Terri Yaki:
PA has some odd laws (as I suspect we all do to some extent). For defensive purposes, your car counts as you home. IOW, if you are in it and someone tries to break into it, deadly force is justified in defending your place. If you're not in it, deadly force is not justified in stopping someone from stealing it. In PA, open carry is legal for all who are not prohibited gun owners. However, until this case was adjugated, one not licensed to carry concealed was only allowed to transport their short gun to a range, gunsmith or dealer. And then the weapon had to be unloaded and out of reach of the driver. So, you can walk out your front door and anywhere you want to go and legally enter with a pistol but you couldn't drive somewhere then open carry.
